Ustavni sud Kosova doneo odluku o oceni ustavnosti Pravilnika o postupku i dokazima

Specijalizovano veće Ustavnog suda danas je donelo odluku o oceni ustavnosti Pravilnika o postupku i dokazima.

Pravilnik je bio upućen Specijalizovanom veću Ustavnog suda radi utvrđivanja usaglašenosti sa Poglavljem II Ustava Republike Kosovo.

 

Poglavlje II Ustava odnosi se na osnovna prava i slobode.

Pravilnik o postupku i dokazima (‘Pravilnik’) reguliše vođenje postupka pred Specijalizovanim većima a usvojile su ga 17. marta 2017. ostale sudije Specijalizovanih veća Kosova na svojoj prvoj plenarnoj sednici.

Sudije Specijalizovanog veća Ustavnog suda nisu učestvovale u njegovom usvajanju.

Pravilnik je 27. marta 2017. upućen Specijalizovanom veću Ustavnog suda.

Troje međunarodnih sudija Specijalizovanog veća Ustavnog suda raspoređeno je u Panel Ustavnog suda.

Takođe je raspoređen i rezervni sudija. Shodno Zakonu o Specijalizovanim većima i Specijalizovanom tužilaštvu (‘Zakon’), Veće je imalo trideset dana da preispita Pravilnik.

U današnjoj odluci, Specijalizovano veće Ustavnog suda proglasilo je zahtev za ocenu ustavnosti prihvatljivim.

Podsetilo je da, shodno Zakonu, Pravilnik mora da odražava najviše standarde međunarodnog prava ljudskih prava kako bi se obezbedilo da postupak bude pravičan i ekspeditivan.

Nakon što je pregledao 208 pravila usvojenih na plenarnoj sednici, Sud je utvrdio da devet pravila nije u saglasnosti sa Poglavljem II Ustava.

Takođe je zaključio da u pogledu još jednog pravila ne može da kaže da je usaglašeno sa Poglavljem II Ustava.

Zaključci suda u odnosu na pravilnik se sada šalju plenarnoj sednici sudija na dalji postupak u vezi sa odredbama o kojima je reč. Sudije Specijalizovanog veća Ustavnog suda neće učestvovati u tom postupku.

 

 

Vendim mbi Referimin e Rregullores së Procedurës dhe të Provave

 

 

Sot, Dhoma e Specializuar e Gjykatës Kushtetuese nxori Vendimin mbi Referimin e Rregullores së Procedurës dhe të Provave. Referimi synonte garantimin e përputhshmërisë së Rregullores me Kapitullin II të Kushtetutës së Republikës së Kosovës. Kapitulli II i Kushtetutës trajton ‘Të drejtat dhe liritë themelore’. Rregullorja e Procedurës dhe e Provave (‘Rregullorja’) rregullon zhvillimin e procedurave gjyqësore para Dhomave të Specializuara dhe u miratua më 17 mars 2017 nga gjykatësit e tjerë të Dhomave të Specializuara të Kosovës, të mbledhur në seancën e parë plenare. Gjykatësit e Dhomës së Specializuar të Gjykatës Kushtetuese nuk morën pjesë në miratimin e Rregullores. Më 27 mars, 2017, Rregullorja iu referua Dhomës së Specializuar të Gjykatës Kushtetuese. U caktua një panel prej tre gjykatësish ndërkombëtarë të Dhomës së Specializuar të Gjykatës Kushtetuese. Gjithashtu u caktua edhe gjykatësi rezervë. Në bazë të Ligjit për Dhomat e Specializuara dhe Zyrën e Prokurorit të Specializuar (‘Ligji’), paneli kishte tridhjetë ditë për shqyrtimin e Rregullores. Në Vendimin e sotëm, Dhoma e Specializuar e Gjykatës Kushtetuese u shpreh se Referimi ishte i pranueshëm. Dhoma e Specializuar e Gjykatës Kushtetuese kujtoi se, në bazë të Ligjit, Rregullorja duhet të pasqyrojë standardet më të larta të të drejtave ndërkombëtare të njeriut me synimin e garantimit të procedurave gjyqësore të drejta dhe të shpejta. Pas shqyrtimit të 208 rregullave të miratuara nga Plenarja, Gjykata konstatoi se nëntë prej rregullave ishin në mospërputhje me Kapitullin II të Kushtetutës. Gjykata gjithashtu u shpreh se nuk mund të nxirrte konstatim nëse një rregull tjetër ishte në përputhje me Kapitullin II të Kushtetutës. Vendimi i Gjykatës në lidhje me Rregulloren do t’u dërgohet gjykatësve në Plenare për të ndërmarrë veprime të mëtejshme mbi dispozitat përkatëse. Gjykatësit e Dhomës së Specializuar të Gjykatës Kushtetuese nuk do të marrin pjesë në veprimet e lartpërmendura.

 

Judgment on the Referral of the Rules of Procedure and Evidence

 

The Specialist Chamber of the Constitutional Court has today delivered its Judgment on the Referral of the Rules of Procedure and Evidence. The Referral aimed at ensuring compliance of the Rules with Chapter II of the Constitution of the Republic of Kosovo. Chapter II of the Constitution concerns ‘Fundamental Rights and Freedoms’. The Rules of Procedure and Evidence (the ‘Rules’) govern the conduct of proceedings before the Specialist Chambers and were adopted on 17 March 2017 by the other Judges of the Kosovo Specialist Chambers at their first Plenary meeting. The Judges of the Specialist Chamber of the Constitutional Court did not participate in their adoption. The Rules were referred to the Specialist Chamber of the Constitutional Court on 27 March 2017. The three international Judges of the Specialist Chamber of the Constitutional Court were assigned as a Constitutional Court Panel. The Reserve Judge was also assigned. Pursuant to the Law on the Specialist Chambers and Specialist Prosecutor’s Office (‘the Law’), the Panel had thirty days to review the Rules. In today’s Judgment, the Specialist Chamber of the Constitutional Court declared that the Referral was admissible. It recalled that, pursuant to the Law, the Rules are required to reflect the highest standards of international human rights law with a view to ensuring fair and expeditious proceedings. Having reviewed the 208 rules which were adopted by the Plenary, the Court determined that nine rules were not consistent with Chapter II of the Constitution. It also found that it was unable to declare one further rule to be consistent with Chapter II of the Constitution. The Court’s determination in respect of the Rules is now sent to the Judges in Plenary for further action on the affected provisions. The Judges of the Specialist Chamber of the Constitutional Court will not participate in that action.
